his reply...........

"Yes i also have a copy of that message (the bike was not in a fire at all, however it was in my garage when a car caught fire in front of the garage, as i described it needed tlc and has been sat around for a while now, the 24/7 crank alone is worth what you paid, i clearly put the frame will need stripping, i was gonna rebuild it but i bought another now, its was sold as i said in need of tlc and stripping not just a clean as for some reason that is what you think, not at any point in the description have i said its all in good condition and a working condition, ) NOTING PLEASE where it says bike in garage car OUTSIDE garage. No it isn't RIDEABLE as it is only parts!! AGAIN!! like i said before as a good will gesture on my behalf i have no problem giving you a refund of the amount you paid for the bike but i will not refund postage and packaging costs as the item was sent to you as requested by yourself. As i had stated local collection. The DESCRIPTION did say it will need strippin"

he also has offered to refund me £182 and i have to stump up the other postage costs to send it back...........

my reply................

"hi , i will not be led into an argument sorry........ your bike is fire damaged , are you dening that ? was the bike damaged in the fire ? "

this'll be intresting

Don't be. Forget about it, in a couple of days you'll get your money back.

It's Friday night, go and have a nice night out! Don't waste any more time on trying to talk to him, the Paypal system has it now.

how does the refund work ? does paypal refund me THEN i send hid char-grilled bike back with proof of delivery ? or do i send the bike back first ?

Paypal will take the money from him, and leave it in a holding account where neither of you can touch it until the dispute is closed. They will take the FULL amount from him, leaving you nothing more than the cost of return post for the goods (you will need to provide evidence of this, so a tracking number is essential, and he will need to confirm receipt of the good back - if he doesn't do this in a certain amount of time, they will just check through the tracking number - he really will have nowhere to hide on this one). Then when it's all done and dusted and the money's rightfully back with you, you can leave him some choice words in his feedback that will hopefully warn off any future buyers!

His offers of good will are utter shite,

i think cause i'm a really big , big built guy i'm not used to people messing like this with me ? i'm not a big hard nut , i just look the part

god help the boy if he lived closer as i would'nt of bothered with ebay

Don't get into any more debate with him - it's going nowhere.

Start your dispute, the funds should get frozen by paypal, use your pictures and the description (and omissions) from the auction page.

I would have thought you'll almost certainly get all the money you paid, including the costs to send to you.

I'm not sure how the return costs get sorted - although I fully believe you're entitled to those as well.

Make sure you return it by a trackable means.

Make all your dealings with the seller through the dispute, now.

edit: just point out it's fire damaged - it's irrelevant whether the burning car was in the same room, merely that it was in proximity.

That there's no mention of it being fire damaged in the auction (to the degree that it's entirely likely that the photos were taken at such an angle as to obscure this).

That such heat will have had a damaging effect on it, beyond the cosmetics (which is the key thing that I think the seller is either ignorant of, or deciding to ignore).

And that this damage is materially different from the description of the condition of it in the auction.

Only do that through the dispute console, and support it with any photographic evidence you can - just makes your case even stronger.

Yeah, but why bother? It's an inconvenience, nothing more.

You are going to be fine.

some people tend to think that distance=safety

The only time i've not been able to contemplate travelling to see some little urchin, was this one time that a woman in France stole all my camera gear that I sold her. Told Paypal/Ebay it was knackered and sent me back a box of broken bits. She kept the cameras and equipment, sold them on for a profit and got her original pay-out back from paypal too.

I went absolutely ballistic at paypal for months, and then in the end, I just took a step back and realised I'd been financially raped from all angles and nothing I could do about it.

I've not had a single good transaction from a French ebayer (and I've had quite a few) so I 100% don't deal with them now, it's the safest way, for me....

And when you've done all that, make sure you add them to your banned bidders list, it will stop them bidding on anything you might list in the future
