Start your dispute, the funds should get frozen by paypal, use your pictures and the description (and omissions) from the auction page.
I would have thought you'll almost certainly get all the money you paid, including the costs to send to you.
I'm not sure how the return costs get sorted - although I fully believe you're entitled to those as well.
Make sure you return it by a trackable means.
Make all your dealings with the seller through the dispute, now.
edit: just point out it's fire damaged - it's irrelevant whether the burning car was in the same room, merely that it was in proximity.
That there's no mention of it being fire damaged in the auction (to the degree that it's entirely likely that the photos were taken at such an angle as to obscure this).
That such heat will have had a damaging effect on it, beyond the cosmetics (which is the key thing that I think the seller is either ignorant of, or deciding to ignore).
And that this damage is materially different from the description of the condition of it in the auction.
Only do that through the dispute console, and support it with any photographic evidence you can - just makes your case even stronger.
so shall i send the photos i have taken to ebay to show the damage ?
