Hello.

I am rushing on my lunch break so long story short.

Someone was tired on the motorway.

The motorway signs say if tired take a break.

Someone pulled into a service station and went to sleep.

Someone woke up and drove on their way refreshed and driving safely.

Someone started to receive letters threatening court action because someone stayed in the carpark to long (a couple of hours, someone was asleep) :roll: .

NB: Someone never knew there was a time frame for using a services. Someone never saw a sign, then or since. Someone also bought food before sleeping and after so thinks a liberty is being taken!

In dealing with the letters, someone has denied being the driver, services agent cannot prove someone was the driver.

Someone is now happy to ignore the letters? Or will it go to court anyway?

Thank you for any advice, someone will be very happy when this is over.
 
Did Sleepy not have any notes on their car indicating they'd outstayed their welcome and needed punishing??

If there's no sticker or anything on the car, and they didn't wake you up too tell you too "get lost" they've got about 0% of winning
 
If it was private land, then parking fines are not enforceable.
If it wasn't private land, and a parking ticket was not properly served (ie, on your windscreen), it is also not enforceable.
 
Most services are 2 hour limits, with plenty of signs. But if you were in the car at the time asleep, I cant imagen they have a lot to stand on.
 
If the receipts for the pre and post snooze purchases have been kept, that may help too .. if anyone decides to take it further, that is..

The person was asleep in the car apart from when inside buying stuff.

There was no note on the car or tap on the window and they never saw any signs.

These letters have just started showing up.

Thanks for all the other information. We'll be ignoring any other correspondence then. Cheers.

P.S. I think I have all the receipts.
