I see where you're coming from, but I disagree.

If he deals with paypal as a dispute and follows that, he'll almost certainly be awarded all the money he paid.

The return costs, I'm not sure of - in terms of the mechanism for how you get them back, because I've never had to do that for an ebay / paypal purchase, although have had to with an e-teller (had to go through trading standards, though, before they'd decided to pay back my return costs). One thing I am fairly sure of, though, he's certainly entitled to a refund of the return costs, regardless of whether it makes the seller out of pocket, or not. He's not just changed his mind about something he bought, he's found it in significantly different condition from that which it was advertised.
 
What Neil's been saying. Doing anything but going through the eBay dispute process is silly. If necessary, ring them, they usually get it sorted pretty quickly.
 
i honestly don't think you'll have an issue he's blatantly not told the truth and missed out the damage.

e-bay and paypal (certainly when used on e- bay) are very good at that (i suppose you have to be good at one thing for your customers) Stick with the e bay and paypal process and it should all be good.

Refund information:
The seller offered a partial refund of £182.00 that will be issued through PayPal within 3 days if you accept the offer.
Seller's note:
"I am offering you a refund Upon receiving item, thanks"

this guy thinks i'm stupid enough to send him the bike back and be left with nothing..........

my replly.........

"hi , this will be the last time i ask you for a full refund as you are being very obtuse and unhelpful. if you refund me the full £212 i will post your bike back to you at my cost recorded and you will have the tracking number as soon as i have it..... this way you'll avoid negative feeback and will save ebay/paypal being involved..... the ball is in your court....."
 
I'd have thought he hasn't a hope in hell of avoiding negative feedback - at least I hope that's the case?

Personally, I wouldn't negotiate. Deal with it as a dispute through paypal, you should get all your money back.

If he goes the paypal route first,Big Eck takes some money from his bottomless supply and duly sends off the parts back to whence they came. The seller says. 'This isnt in the condition i sent it in'.
Paypal has to investigate further yes?
Seller goes to wherever and gets a favourable quote[from a mate ,who knows,certainly not paypal]
this leaves the ball in the sellers court holding both the bits and ecks funds

Possibly OK POSSIBLY
But why risk that

Eck threatens legal consequences gets his funds from the seller without involving paypal
Balls now in Mr Ecks court
He could even force the seller to pay the return postage[ecks under no legal obligation to pay the return costs]
Even if this wasnt the case ,by involving paypal ,ebay and most importantly RULES ,you risk paypal sending emails telling him how it all works and where he stands in things
As its pretty obvious that the seller doesnt know the law or he wouldn't have tried to placate Eck with a partial refund

I say accept the £182 then send it back after its been in another fire,been jumped upon several times by the big chap
And had dog shite wiped on it just prior to posting
No body likes finding doggy doo on their hands

Or Yeah Mate.I sent it standard parcels.......What it hasnt arrived :? ...receipt ?? Sorry,ive looked and looked,but i cant find it anywhere :evil:
