ebay advice badly needed please REFUNDED :)

What a tosser!

From (sadly) my dealings with e-bay and the like you will get your money back.

Saying all the components are in working order but the frame "will need a strip and repaint" is a bloody great big porky! The fact he chose to omit the facts and carefully set up his picture to is going to go 100% against him.

Please do let us know when you get it all resolved to your satisfaction.

i had a small conversation with the seller............

hi , bike arrived today and is in need of a little more than some tlc as it's been in a fire and all the bearings in the rear of the frame are half melted , the fork stanchons are stained/tarnished and both seals are leaking due to fire damage too .

both wheels are covered in soot and the rear had been burnt , i don't need to ask what happened to all the cables as there all melted all over the frame which has had most of it's paint burnt off at the seat stay down to the main tube.

sadly theres no way i'd of pay'd even your starting bid of £99 if you had listed the bike as fire damaged.....

therefor i'd like to return your bike as it's no good to me the way it is and i never set out to buy a bike that had benn half melted , sorry

his reply...........

the bike was not in a fire at all, however it was in my garage when a car caught fire in front of the garage, as i described it needed tlc and has been sat around for a while now, the 24/7 crank alone is worth what you paid, i clearly put the frame will need stripping, i was gonna rebuild it but i bought another now, its was sold as i said in need of tlc and stripping not just a clean as for some reason that is what you think, not at any point in the description have i said its all in good condition and a working condition,

my reply...............

hi , i was'nt expecting a ready to use bike by any means but to not mention that the bike was half melted isnt really fair and was'nt in the discription hence why i bought it .

there is no doubt the alloy frame has been weakened by the heat just like the rear wheel has been , the frame is only fit for a wall or a skip .

the forks are totaly knackered too , the stanchons are porous (full of small holes where they have been on fire) and have burn marks all over them including what used to be the front brake cable .

i really can't see anything in your listing saying fire damaged or has been exposed to fire so your listing was'nt accurate or even close to the truth of the condition of the bike.

will you please refund me and i'll send your bike back ?

i don't think this guy wants his bike back
Start a dispute, now - did you pay by paypal?

You could subtly mention that his current 100% feedback looks in jeopardy... ;-)

yes i pay'd with paypal , he has offered me a £50 refund

latest reply from seller........

"Out of good faith i am prepared to offer you a partial refund as i have clearly told you SERVERAL times and wrote in the description on eBay the bikes has NOT been in a fire, but has been sat around and will need stripping. It was in No way warped so i am not sure i can take your word for that. The pictures and description are to the best of my knowledge accurate and fair and i feel that you are being unfair and i cannot refund your postage costs etc as then i will be out of pocket then. I am trying to be fair on both our parts so feel free to contact me again to sort this out and as soon as i recieve the item back i will give you a refund minus my expenses, Thanks again"

my reply..............

"hi , no thankyou . your bike was in the same garage when your car was on fire (you told me yourself in an e-mail which has been forwarded to ebay) it IS NOT RIDEABLE AND NO AMOUNT OF TLC will make the frame rideable DUE TO THE SAME HEAT THAT MELTED THE CABLES AND PAINT . therefor i do not want it as it was'nt listed properly . i would like a full refund of £212 and as a good will gesture on my behalf i'll (post it back to you)at my cost.. ""

i'm tempted to go to dorset and wrap the frame around his neck.......

his reply...........

"Yes i also have a copy of that message (the bike was not in a fire at all, however it was in my garage when a car caught fire in front of the garage, as i described it needed tlc and has been sat around for a while now, the 24/7 crank alone is worth what you paid, i clearly put the frame will need stripping, i was gonna rebuild it but i bought another now, its was sold as i said in need of tlc and stripping not just a clean as for some reason that is what you think, not at any point in the description have i said its all in good condition and a working condition, ) NOTING PLEASE where it says bike in garage car OUTSIDE garage. No it isn't RIDEABLE as it is only parts!! AGAIN!! like i said before as a good will gesture on my behalf i have no problem giving you a refund of the amount you paid for the bike but i will not refund postage and packaging costs as the item was sent to you as requested by yourself. As i had stated local collection. The DESCRIPTION did say it will need strippin"

he also has offered to refund me £182 and i have to stump up the other postage costs to send it back...........

how does the refund work ? does paypal refund me THEN i send hid char-grilled bike back with proof of delivery ? or do i send the bike back first ?

This may be a load of old cobblers, so don't take it as gospel

Got a feeling Paypal may only refund if he has the cash in his Paypal account.
So if he has ripped it out you might have a few problems, don't want to worry you, but that happened to a mate of mine a while back for a lesser sum
Think it has probably changed due to consumer pressure, but they certainly don't like paying out their own money

Ebay will advise whether you need to send it back and if you do to obtain proof of postage with associated costs

Worth investigating thoroughly on Ebay about their buyer protection policy, they are all thieving bleeders really

That used to be the case, but not anymore. They can take the money off his credit card if he doesn't have a Paypal balance.
