ebay advice badly needed please REFUNDED :)

as far as i can see , paypal will refund me in full within 3 days , i'll send the bike remains back to said twat and paypal will take the money straight out of said twats paypal account or bank if the accounts not got enough funds :wink:

ebay will then wait for the seller (twat) to contact them saying that the remains are back with him (which he more than likely won't do) and after 10 days they will request a tracking number from me to check i have posted it.

i have the right to claim the postage for sending it back to him and ebay will chase him up for that too (which i 100% will be doing)

so i think i have him over a barrel just now :wink: but i'm not getting too cocky about it............ yet :twisted:

My thinking is that paypal are likely to refund the whole lot to him.

I agree he's entitled to the return costs - but not sure how that plays out.

Accepting interim offers, or debating, surely just muddies the waters.

Sticking to a consistent argument, with photos, showing it's simply not as described, tantamount to fraud.

If you don't return something trackable, when under a paypal dispute, doesn't it make the buyer at risk?

Absolutely - you shouldn't be out of pocket at all.

You haven't just changed your mind about something, or not appreciated it once it's arrived like distance selling normally protects.

You've received something that wasn't as descibed - in fact it very much sounds like an attempt to cover it up (even after the seller accepting it has damage due to the fire) - which could be construed as fraud.

Like you, I feel that if you stick to your guns, paypal should refund everything to you - although may wait for the delivery / tracking to complete.

I'm unsure about how the return costs are obtained - whether paypal effectively force it, or simply strongly encourage the seller to, but you are most certainly entitled to them.

Play it straight and simple, no more debate.

How did you fund the paypal payment - if it's credit card, you're golden - because even if paypal let you down you could still chargeback, might be able to with debit card, but if it was from a paypal balance, or straight from your bank account, then I guess it's just down to paypal - even so, though, normally the buyer prevails, these days.
 
You will definitely get all your money back for the original purchase, but I'm afraid you'll still lose the costs of the return postage, unless they've changed things since I last had an ebay dispute, back in september or so.

I bought a chris king headset which the seller had described as being in very good/almost perfect condition. It was in the picture, so I had no qualms about bidding, but what the seller had done was rotate all the components of the headset so all the good parts were shown. On the reverse side were massive scratches and gouges and multiple areas of damage.

I just followed the ebay/paypal dispute process, taking lots of pictures and detailing all the damaged areas and got the original purchase price returned, but still got landed with the postage cost for returning the item, luckily just a headset, so no massive loss.

Afraid this is the chance you take with ebay, i've bought and sold hundreds of times and only been burnt once, so worth the risk imo.
 
Stick within the dispute system and maybe get some corroborating information from your LBS as to the frame and parts being damaged beyond any use and only suitable for throwing in the bin and see what their decision on returning the goods to the seller are as he may just try and sell the item again. Do leave negative feedback, that is what it is there for and if he leaves neg feedback for you then attach a note to it explaining the reason. You have nothing to worry about, your claim is very valid and worth pursuing as you are. Just bide your time and it will come out in your favour.

Anyway, good luck on getting the money back.

Sellers can't leave negative feedback, now, although they can leave a positive with negative comments.
 
Leave it up to Ebay to resolve the dispute.

I'd say you have a water-tight case, as the seller avoided showing the worst side of the frame and failed to describe the extent of the damage; and the nature of the damage - there's no way of telling what the heat has done to the structure of the frame & components. So even if you did waste time & money restoring it cosmetically, it might never be safe to ride.

Not fit for intended purpose. Not accurately described as such.

Im pretty sure ebay calls this a positive negative and doesnt allow it.
I could be wrong though :? ,but i seem to remember something about that on one of their forums
 
jeez. you weren't joking eck. those parts are in a right state. what a shoddy seller.

you'll get your funds back but not sure about whether you get your postage reimbursed. hopefully so.

seems to me you just leave neutral feedback or none at all.

anyway, hope this ends happily for you.
