It's one thing having multiple users uploading content to a website which then allows free access and downloads to all users, and another thing actually compiling and distributing electronic copies.
Publishers will generally turn a blind eye to ad-hoc file sharing of older documents and images; it's just the nature of the internet. The implications and costs of trying to pursue a case will put most publishers off.
But when an individual can be easily proven to be distributing material then there may be more chance of a copyright infringement case being pursued, especially if the individual can be seen to be gaining financially from it. A stack of DVDs and a record of sales could be somewhat incriminating...
