if it is not finished should you have been there in the first place ?

and no , we dont pay taxes for that .

but I still agree you should claim for loss of earnings .

Oh dear !!! Sorry Gordon..

Lets not get all political shall we, I just meant that he has no reason to feel bad if he needs to make a claim !! I presume your not self employed then ? !!

dont understand what you mean :?

i agree he should claim if he needs to , and he surely does if he is self employed with no insurance .
I always thought that imsurance companies were paying out when there is a claim , not the taxman . :?:

Genuine injury, claim for sure..

And elbows are a biatch... very complicated joint.

I take it you needed surgery... Mr Packer at Southend Hospital is an incredible surgeon. Even though he couldn't fix mine ;)

at the very least, inform the council / your insurance co (if apt) of the situation and that you are considering your options. Doing nothing now may not favour you at a later date.
edit : and keep it in writing (email/letter). A phone call is easily forgotten/denied.

If you use email or post make sure it is tracked/recorded in the initial instance so you can prove it has been received..

Yeah, sorry... I didnt mean the tax man literally I just meant thats what we pay in for. Insurance policies, national insurance for if your hospitalised etc.... We all pay insurances for one thing or another !! Make a claim if genuine :D

riding along our new seafront cyclepath the other night about 8 oclock which is still being finished off and is coned off nearly all the way

If you knew it wasn't finished then why were you riding along it ? weren't the cones a big enough give away ? and what does being self employed have to do with it ? oh and I was self employed for many years and believe that your accountable for your own actions . Did anyone make you ride along it ?

Should have been paying attention really . With the money you won't get from the council as it was unfinished they can instead spend it on an ad campaign stating the obvious .

I broke an elbow years ago because I wasn't riding good enough ( serves me bloody right  ) and it clicks and locks quite often . Make sure the Docs sort it out properly , don't let them fob you off ; An elbow that clicks and locks really isn't very fun at all .

Should you really have been on it ?. That will be the first thing that will be asked. Seems quite obvious to me that you either shouldn't OR should have being used caution while riding along it if it was allowed.
May just have been kids having a laff moving it across, who knows?
But I've not been down there and do not know what is there.

First I would look in to your insurance if your policy or you pay in to a specific one to cover this sort of thing.
Second I would see what the state can provide. Must be some unable to work entitlement.
Third talk to a solicitor to see if you have a case. From what you say in you post, my opinion is you havn't and should have taken more care. But then you can probably claim for twisting your ankle crossing a cattle grid in high heals
