What would YOU do ?

In the 1st place: If I got something wrong, I would first ask myself whether it was due to poor spec or if it is my own fault. In case the later, I wouldn't dare to ask to take something back. In case of the poor spec, I can still imagine it would be easier to write something off or sell to/swap with another person, instead of sending something back. Not in all cases. Depends. What I mean to say is that 'wrong' doesn't automatically mean refund in the 1st place.

A destroyed item rules out a refund. Kindest you could do is going the route of refunding the residue value to the seller. In this case next to nothing. I would still find that generous.
 
If the facts are as you say, then you owe him nothing. I'd offer to send the brace back to him if he pays the shipping again.

Thinking about it, you should be charging him a re-stocking fee :lol:

I think it is bad form from the buyer to expect a refund at all, let alone of an item they have fubar'd....

I have mistakenly bought items off here and elsewhere which were wrong but that is just my mature cheddar (hard cheese) for not checking correctly. You emailed a pic and described the item accurately..surely the buyer has to take some responsibility here...

As already mentioned elsewhere, in cases where i have purchased incorrectly it is up to me to either sell on or store for future use...
 
Did he buy the item thinking it was as the picture you had emailed? In the normal way of things if you sent something that was not per the picture a refund should have been given.

However this supposes that the goods are returned in the condition they were despatched. If they are returned damaged, as you suggest then the purchaser can't reasonably expect a refund in my view.

Maybe a partial refund might be in order if the purchaser felt misled in the first place.

The thing that annoys me is not only did he not send back an Item in the same condition as it was sent ,but he has had NO communication with me regarding the brace ,it was only when I pm'ed him to ask if it had arrived did he tell me it was the wrong one ,then silence till a piece of scrap lands through my door with a scribbled note asking for his money back !!

In that case suggest maybe to pm him and say you cannot refund his money since the goods have been returned in a damaged condition and invite him to contact you to discuss the situation. After all you have both the money and the(damaged) goods at the moment!
