Help needed!!
Just started using flea bay and sold some clothes etc for retrobike funds.
Now the guy who bought 3 items wants to return them? Where do I stand?
I stated no returns as it's all worn/last season prada? But how I explained?

Any tips as what I should do? It would be much appreciated as I want good feed back to start trading?.
Thanks Daz :(

Are the reasons for wanting to return reasonable?....namely, poor or innaccurate descriptions or photos?......if not then I think you are ok to refuse.....this would be the common sense starting point for eBay to deal with a complaint from them should it happen.....

If i was you especially just having started out i'd refund him but ask him to ship the stuff back to you and re-list the stuff...its really not worth getting a negative feedback when you have just started.

If you have a lot of feedback already from buying you could just tell him that you feel they were described properly, the only problem is that paypal tends to side with the buyer.

Good advice who pays the post me?
But the feed back is the main point. It's all bought from selridges to and tidy items, o well live and learn the attitude is still a dream!
Thanks lads Daz

i wouldn't pay for the postage, because you paid for the postage out to him the cost of sending it back should fall to him because he is the one wanting the refund...consider it a restocking / handling charge

good point re the feedback.....i guess thats down to you daz, sleep on it and decide with a clear head......

A few things if I may

as mentioned the reason for wanting to return is key. If it's just a chancer tried them and didn't like them then your not a shop and as you clearly mentioned no retrurns then as long as you didn't break any rules then I wouldn't personally entertain them.

If you do feel you want to return then along the lines of..The items were declared correctly and made clear there was no returns. However should I do allow this then you must understand that the return postage to me is at your expsense as royal mail does not give refunds

if they are happy with that and you are then get the goods, relist, refund and put it down to experience of the fickle world of ebay

If however you do not feel you should and get a negative..if you've only just started and your feedback is very low..close the account and start a new one

unfortuneatly with clothes on ebay many treat it like a next catalogue thinking they can return anything they do not want to buy

In 'face to face' sales, that's absolutely correct because the Sale Of Goods Act 1979 applies; goods must be (i) accurately described, (ii) fit for purpose and (iii) of merchantable quality.

But on the internet, the rules of the game are governed by the Distance Selling Regulations 2000. The 'key' here is whether Daz's sale was conducted via an auction listing or a Buy-It-Now listing.

If it was an auction, then the law favours the seller and expects the buyer to know what they're buying for before they bid. But if it was a BIN transaction, then the law is on the side of the buyer -- if he asks for his refund within 7 days, he doesn't even need to give a reason for it.

I'm not sure who's expected to pay for the return postage. I think Daz will have to haggle with the buyer over that one...

i am not sure the distance selling regulations apply in the case of an individual selling off his own goods.

the buyer is definately responsible for return postage - if he opens a dispute paypal instruct him to return the item and give a tracking number. once that is done the original amount is refunded. so you lose the original postage but they pay the return.
