Bike vs car accident; any advice?

IIRC if you were hurt he had a legal responsiblity to call the police. If you had a witness contact them then go to the police with the details of the accident. Let the insurance company know that you have contacted both the police and the witness and that you are not happy. Then tell them you feel it is getting too complicated so you think you need to engage your own solicitor. Most household insurance has a free legal advice/cover option - do you have that on your's?

I'm pretty sure as others have said you got the before and during covered

the next bit is the same as cars..they will offer a shitty sum

so start to see how much replacements are, if it's an older model then the obvious ebay/cycling forums etc for comparisson prices but personally I would push for new. If it is high end and you have added extras I doubt they will apy for those

they may try say offering a compramise say a new frame/forks with a local shop doing the swap of the good parts..personally I would say no

as mentioned, if you feel you have been injured then an ambulance chaser is a must..it may take a few years to get to the end result but right now you may not feel the full effect of the accident so I would say better to record it through these less than savoury characters

I was not injured thankfully so i'm just want my £1000 road bike fixed or replaced. The solicitors i've spoken to aren't interested as it isn't a personal injury claim. I've been told to go through the small claims court as a last resort.

thanks to you all for your help/advice

I'm now waiting for the insurance assessor to get back to me with an offer to replace my bike. I've read that you never accept the first offer so i'm ready for some negotiating i think!

Its taken weeks to get to this stage and many phone calls. If hadn't been so persistent it would have never got to this stage. Lucky I had a witness who saw the accident or it would have been my word against the car drivers (who lied and said i pulled out in front of him!).

Wish I'd called the police to the accident to back up my claims to the insurance company. Lucky I've got a witness who saw the accident to back up my view.

Hopefully will all come good in the end.
You can report it retrospectively, might be worth doing, just in case.

Finally settled my claim. Accepted £700. Not too bad seeing as i paid about £1000 in 2005 for my bike.

Well i'd be counting half of that as compensation for the stress and hassle the accident caused.
