Another Ebay question

Sorry could not find related post in search, but just need advice on how long to leave it.

My situation.

I bought a some bars off eBay 12th March, using my mobile, and realised after purchasing that the estimated delivery was March 30th -16th April, they were coming from Taiwan I really wanted some much quicker so I searched again and came across a BIN Ritchey set, in England, so I bought them, he had over 500, 100% positive feedback so I wasn't worried. Yesterday, one week later, the postie delivered the Taiwanese bars :shock: yet I've had no ward at all, such as dispatch notification, or seen any sign of my bars from the British eBayer. I wrote to him yesterday early afternoon and not yet received a reply, I know that was only 24 hours ago, but do I start a dispute now, or give it another day or two or week? just not done this before.

I'd wait another 24hrs before going the next step as maybe the seller has a family emergency etc..

Open a case now Alison, I'm well and truly fed up with sellers on ebay that can't be arsed to either post promptly or at least drop you a short message explaining the delay.
 
I've opened a case, he's had 48 hours to respond to my email and I'm fed up about it :(

He has till 29th March to respond before I can take it any further. Funny been on ebay since 2005 and this is my first dispute, although I've had a couple of problems, I've just cut my losses before.

Update:

Well after opening the case Friday 21st I received a message on Sunday saying "Seams a bit odd you are wanting a refund so quickly I said I sent them out, then the next day you open a case, hardly seams fair"

I responded by saying, that I had received no emails from him at all, no dispatch notice and no explanations of the delay, he responded to me saying basically he had been away, was unaware they had sold and and had written to me when he got back and that he had, in his ebay sent box, the message he had sent me. I said I had received nothing at all and as I was completely in the dark and basically knew nothing so I think my response was justified, he agreed and asked how I wanted to proceed, I said "as I now know you have sent them, I'm content with that"

Now note the DIRECT quote of his first response to the case being opened, I then get this message "No they are not, they were not sent as you opened the case, so today is the only time I've had to try and sort it out, so it is up to you" :shock:

Anyway I told him to to send them and on the 26th I got a message he'd sent them and they arrived this morning, condition a little less good than described but I'm leaving it at that and I'm not going to go out of my way to ruin his feedback rating, but in the end some resolution was found :)

I always have 3 days in the dispatch time of my sales as quite often I can't pack straight away or get to the post office the next day. It at least gives any buyers the heads up it's not going to be with them next day. After all I am not a business and have a lot of other things on my plate.
