I noticed yesterday that, after weeks of the willow tree in my back garden slowly looking like it was dying and blaming it on the hot weather, my neighbour has drilled three holes in the base of the trunk and poured some horrible shit down there!!!! And while I was on honeymoon too the arseholes! Bearing in mind we've been very supportive to them - he's just had a stroke and we've offered to do plenty of things for them wherever we can, I'm fecking fuming!!!!!!

I'm doing my best not to go round there and kick F🤬🤬k out of their garden, looking like a liberal coating of glyphosate may be in order though :evil: :twisted: :evil: :twisted: :evil: :twisted: :evil: :twisted:
 
There's no real proof - I know it was them, they know it was them, but I didn't see them do it!!!! So frustrating!!!!!
 
That takes the piss mate, if it's on your property too it's also illegal and to replace a mature tree is bloody expensive don't get mad get even! :twisted:
 
Then have them for trespass, loss of amenity,costs of replanting (and nurturing) etc.
A good ambulance chaser would love this!

Although, I would consider that if it's a willow tree then it probably has a Tree Preservation order against it, and you probably live in a conservation area. And is the cost of replacing the tree more than the poor neighbourly relations that will ensue from litigating against your neighbour ("Hear about those at number 45? They are suing Number 43 for £5,000 AND he's only just had a stroke, poor fella"), and the subsequent "any neighbourly disputes" question when it comes to selling up and moving?

But, yeah, I'd be pretty narked.

That's the point, he can't.

While you have a weak case without proof, you can assure yourself with the following test:

Who has a MOTIVE to do it?
Who had the OPPORTUNITY to do it?

Crimes are a result of motive and opportunity. What was your neighbour's motive?

If you're convinced it was him/her there are many ways to get your own back, and I don't mean the 'watercress through the postbox' type. If I'd had a stroke I'd be very careful upsetting anybody!
 
In civil proceedings, it's on the balance of probabilities. So, you'd need >50% to win. Just saying "Well, he told me he didn't like the tree, once" and then we were away, so it must have been him" probably won't cut the mustard.

Motive and opportunity don't really come into proceedings in civilised lands.
 
The past two years I've cut the willow back when they've asked, this year, along with the bad weather, I've been flat out with work and organising/getting married. I haven't got around to cutting it back. The neighbour has never liked the tree and has quite forcibly told my wife to cut it down before. He is a horrible, bullying, misogynistic old bastard and he won't be getting away with it. I have no concrete proof it was him but I know it was him or on his orders this was done, and I WILL get my own back.
