I am not a structural engineer, but I'd probably risk that. Seat tube is one of the better places to have damage - relatively little stress and a failure there should lead to less sudden failure than most other places on a frame. Plenty of places offering carbon fibre repairs these days, putting a "bandage" round the frame to reinforce it would probably be the best solution.

I still ride my '04 one of them as my main XC bike. Lovely bike IMHO, I'd be tempted if that was in my size!
