What's this tree?

It's badly overhanging my garden from a neighbours and I need to know what it is before I can decide whether to brutally chop it back to the boundary or to just tidy it up..

Bloody hell it's growing in your house, now that is a bush that's out of control and needs to be neatly trimmed.

Have you asked them to trim it?

That'd be the 1st thing to do
 
The missus is going to speak to them.. it's not a bad looking item but overhangs by about 15', is about 20' tall and drops leaves and (I think) berries..

Need an ID to know whether it's harmful to dogs/ferrets/kids.

Nah, not if it sometimes has berries

If it produced nuts it's be a Wufflenut tree, but as it's berries it's gotta be a Dangleberry tree.

The pic is of a cutting I took and the actual beast lives in the neighbours garden..

The (full size) leaves are about 0.75 - 1" broad and 3 - 4" long..
 
Its a Cotoneaster cornubia (white flowers and red berries), fairly tough old things.

If it is not your tree, you are allowed to prune it but you do have to give everything you cut off to the owner of the tree.
 
Cheers Monsieur Lapin Vert.. I did an online tree ID thing earlier and that ended up with a Cotoneaster.. but the pic was a crappy one and I couldn't tell for sure..

Wife will ask neighbourino whether they want the bits back or not.. I suspect 'not'..

Do you know if it's at all toxic?
