If my contract states my workplace address, and im tupe'd across to the new company, can the new company force me to resign if i dont take up work at any location outside of what is stated in my contract.

I actually want the money, so am not putting my name forward to any jobs at the new location unlike some of my colleagues, btw they havent actually talked about redundancy but it has been mentioned very briefly
 
Does your contract specifically state the address as the ONLY place you will be expected to work? The wording must be exactly precise on this... :wink:
 
well it says my current address, and then located elsewhere within the company, giving another address, but nowhere near my new company's offices

So as it says elsewhere within the company, and i dont work for them, then i still in the clear, and can expect if i dont do anything to get redundancy, yes it will be probably the basic package,
 
and on later literature from my new company as some of us in the office and on different contracts, that the one im on, says its static to that address

I just want to be 100% assured, and dont want them to try and wiggle out of forcing me to resign
 
Yes, but within reason.
Moving you from London to the Outer Hebrides is constructive dismissal.

It's a common game, usually badly done by employers. Get some understanding initially from Citizens' Advice. I'd also seriously recommend considering joining a Trade Union if you aren't in one already.

Yes, I'd certainly recommend seeking proper legal advice. I went through a TUPE a few years ago. Basically it sucked and I left of my own acord after a few months - if I hadn't just wanted the whole thing behind me probably had a good case for constructive dismissal. Another colleague was layed off during the TUPE and took legal advice - he ended up with a bumper payout becasue the contratcs etc were in breach of various employment laws.
 
I know they can not force you to move where I work (Fire Service) if your contract states a specific station. Also can't make you move to a different duty system. They've stopped putting where you work on new contracts. Think you'd have a good case at an ET if they force you to move or force you out.
