E-BAY PROBLEM.... advice please !!!

I won a set of rockshox recon race 100mm forks on e-bay... i paid by cheque which the seller has received.
he has now sent a "request transaction cancellation" he says he will post my cheque back to me as he has now decided that he doesnt want to sell the forks !! :evil: :roll:
they where listed with a bin for about a week, with a best offer option... i offered him about £20 less than the bin... he accepted the offer.

i realise i cant make him post the forks to me , but surely by law he should ?
any ideas ?

This is why I hate cheques. I'm not saying he's a bad 'un but if he were, he now has a lot of your details including a sample signature. Is there nothing in the ebay small print about it?

Sounds OK hopefully. Hold back on the feedback and let him have both barrels (full choke) if they go back on sale! I'm not an expert but surely by accepting your offer and receiving payment, he has entered into a contract with you?

Not any more. Give him the negative he deserves! I can't understand people moaning about transactions then leaving positive feedback. :?
 
There is a legal contract there enforcable in the courts - an offer and acceptance. He can't just change his mind about the sale. If you wanted to you could take him through the courts. That having been said, it's only a bit for an old bike. Is it really worth it? For the ammount it would cost you in time, money and stress you could buy yourself several new bikes.

My advice, take the cheque back & forget about it. You'll find another one.

If it helps, develop a smug sense of satisfaction that you were right and he was wrong coupled with the fact that you're a far better man than he is, knowing when to walk away.
 
well if i get my cheque back, i can still leave feedback... so you can guess what thats going to be like ?
i have sent him a polite message saying that i have cancelled his "transaction cancellation" i would still really like him to sell me the forks !!
i can understand people not wanting to sell there stuff.... but it was listed on e-bay for a week.... and he had my cheque for 3 or 4 days before he decided not to sell them !!
ahh well bad feedback for him it is then.
