As soon as I can get the rest of the seatpost out,the Cinder Cone will be resprayed and rebuilt. The favourite is the Hahanna at the moment,rides wonderfull.

Seems that the plans for respray and rebuild of the Cinder Cone will have to be put on hold at least. The chainstay on the non drive side is not as it should be. The tube is now completely round and I fear that the frame is not safe to ride anymore.

It is difficult to see from the picture, but I dont think there is enough strength left in the frame now. Does anyone know if the frame is safe to ride?

If the rust has not perforated the stay then it should be fine. It is not exactly ultralight ultrathin tubing to start off with, so there is plenty of metal there. Rust usually looks worse than it really is.
