I'm always nervous about bikes that use frame flex as suspension, it just doesn't seem right.

Why? Springs are generaly made out of steel and they seem to do a pretty good job of going boing. Ti ones go boing too if you're feeling flash.

True, but it hurts less if a spring snaps than if a frame snaps  And I've seen more broken frames than springs.

And they'll have all been frames that weren't designed to flex like this one is. The reason you don't see many broken springs is that they're supposed to go boing so you're probably better off with a frame designed to flex than one that isn't.

Back on topic tho... is it the same company? and is that Daryl Funk (in the pics) still producing them as well?

Love the headtube badge, and the bikes look pretty cool too...

Yeah shame about the e-stay thing, but hey-ho that's evolution I guess... :P

Yes, Daryl is still producing them. When I bought my Funk a couple months ago I exchanged emails with Dave @ Funk Cycles. He explained how Daryl always likes to try something new which is how he developed the La Ruta. Now, that's not to say Daryl is actually welding frames, but he's at least involved in the design.
