ebay woes - advice sought

Sent out a record player, intact, still warm from playing - arm secured for transit. Fully insuredvia DHL/ Parcel2go.

buyer claims needle is missing 'item not as described'.

Auction clearly stated 'no returns' no warranty is implied or given'.

buyer signed for the item without checking contents first.

Replacement P-mount cartridges available from about £15 + P&P.

Law see this as a private transaction, distance selling regulations dont apply, consumer protection laws do not apply. Insurance is invalid because the buyer didnt check.

But I'm worried I'm gonna be £200 up the swanny just before Christmas.

Although you are clearly in the right and the other fella is clearly in the wrong :? £15+P&P seems infinately preferable to being down £200.

I lost my 100 prcent because the buyer of an item did not pay and then after three weeks I sold the item to the underbidder and the original person immediately left neg feedback.....they never even paid or recieved the item......muppet :x :x

I'm waiting for 2 6 spd XT thumbies from Cali. Auction won and paid Nov 6 w. shipping within 5 days noted. Guy recorded them posted Nov 13. Emailed him Dec 3 saying they were late. He responded he'd check the tracking and get back to me (didn't). Emailed again on Dec 12 telling them they still hadn't arrived. He emailed me back saying again he'd check the tracking and get back to me (didn't). I'm thinking this Friday (Dec 19) I should start a non delivery claim. Any thoughts?

Oh and for those of you that have less than a 100%, I see this and I always check out the negative feedback remarks in comparison to the positive, as I know there are some unrealistic buyers out there and just pure scammers out to screw sellers over, just as there is the same with the sellers.

But regarding some sellers who mislead with their listing, I am one of the pedantic bar stewards on there that contacts the seller to inform them that their listing is incorrect or misleading, and I check back too and inform ebay if they don't act. The reason for this, is I go by ebay's basic premise, that everyone is largely decent and honest, so I see weeding out the self abusers as the right thing to do.

I have never given negative feedback, gave neutral once or twice, but with second hand goods, what can one expect, especially when there are detailed photos present. People are only human, there open to honest error, I can detect when dishonesty is at play.
