Charging a Newspaper for my Photo?

Hi,

To cut a long story short, I took a photo the other day which a local newspaper have used. They have credited the wrong person (they lifted the photo from Twitter and obiously got it from one of my followers who 'retweeted' me when I posted the photo).

The newspaper have sent me a tweet to apologise as both myself and the person who was credited have now proved that the photo was originally taken by me. They said that they were going to print a correction the following day, which they haven't done.

Can I charge them for using the photo without my permission?
 
What do you want out of it?
Just a credit or hard cash?

If it's hard cash, you could probably get a snotty letter written by some solicitors, or consider taking them to the small claims court. But this is going to be at least £50...and in the latter case you need to leave a day for a court appearance.
 
Don't you have to register an Image somewhere before you can have rights to it?

No you just have to be careful where you upload it and make sure your rights are explicitly stated. I upload a lot of stuff to Flickr but have all my rights set on the site so if anyone uses my stuff then they know it is mine and they are being naughty. Never had to do anything about it though...
 
I have no idea on the law with regard what's stored on twitter, but, yes they are not allowed to nick a photograph of yours normally and publish it without permission. It's theft. But it is now uncontrollable.

That said, thanks to the revolution of digital photography and the subsequent downfall of professional photography - you'll be lucky to get a credit, let alone any money for a published pic to be honest. So getting an apology is in a way quite an achievement.

Last time I was invoiced, space rates were running at about £30-£60 for a small inset pic on a page.

That said, I have accepted a sale from Estonia for 0.26p. :lol: Purely so I can say I won't get out of bed for less than 26p. :lol:
 
slightly unrelated but potentially of interest to a few folk on here is the option to sell your photo's!

a friend of mine who is a keen photographer & musician uses istockphoto.com or something like that. you essentially setup an account then upload all your pictures, tag them for catagories / specific searches then people can use them & pay you a royalty.

He had one picture published in a new york mag last year of my chickens!

he came down & did some sound recordings of various things to upload to another site & took a few of the birds while he was here. he makes a bit of cash from it, nowhere near enough to make a living but he makes enough to be worthwhile, if memory serves me correctly he had some background music he made on a bbc drama a couple of years back.
